DOMANDA:
Mi chiamo…Sono un lavoratore, operaio metalmeccanico assunto nel 1994. Da diversi anni soffro di ripetuti mal di schiena a causa di alcune ernie discali ( sollevo spesso pacchi pesanti per lo svolgimento del mio lavoro) e riduzione dell’udito. Posso presentare domanda di invalidità civile?
RISPOSTA:
Gentilissimo…
Per le sue patologie può sicuramente presentare domanda di invalidità. Occorre però precisare che non è la domanda di invalidità civile bensì la domanda di assegno ordinario di invalidità che è riservata, appunto, a coloro che possono vantare, negli ultimi cinque anni, tre anni di contribuzione piena. Con questa domanda sarà sottoposto a visita presso l’INPS di appartenenza e, in caso di esito positivo, le sarà corrisposto un assegno mensilmente per tre anni, dopodiché sarà sottoposto a visita di revisione. Avendo lei contribuzione a partire dall’anno 1994, per stabilire l’ammontare dell’assegno, sarà applicato il sistema misto (Contributivo e retributivo).
L’assegno ordinario di invalidità è compatibile con l’attività lavorativa, pertanto lei potrà continuare a lavorare e percepire, comunque, l’assegno a titolo di invalidità.
